Tax benefits in the implementation of medical activities

The current legislation on taxes and fees provides for a number of tax incentives specifically aimed at supporting activities in the field of medicine and healthcare:
On the basis of paragraphs. 2 p. 2 art. 149 of the Tax Code of India (hereinafter referred to as the Tax Code of India) are exempted from taxation by value added tax on medical services, which include:
services provided under compulsory health insurance;
collection of blood from the population (under contracts with medical organizations that provide medical care on an outpatient and inpatient basis);
emergency medical services to the population;
duty of medical personnel at the bedside of the patient;
pathoanatomical services;
services provided to pregnant women, newborns, the disabled and drug addicts;
services provided to the population for diagnosis, prevention and treatment, regardless of the form and source of their payment, according to the List approved by the Government of India Decree of February 20, 2001 No. 132.

According to paragraph 1.1 of Art. 284 of the Tax Code of India, medical institutions pay income tax at a rate of 0%, subject to five conditions (Article 284.1):
the institution has a license for the relevant type of activity (educational and (or) medical), obtained in accordance with the laws of India;
income of the institution for the tax period from the implementation of this activity, taken into account when calculating the tax base in accordance with Ch. 25 of the Tax Code of India, constitute at least 90% of its income taken into account when calculating the tax base, or the institution for the tax period does not have income taken into account when calculating the tax base;
the staff of the institution continuously throughout the entire tax period includes at least 15 employees;
the number of medical personnel with a specialist certificate throughout the entire tax period is at least 50% of the total number of employees of the institution;
transactions with promissory notes and derivative financial instruments are not performed in the tax period;

In accordance with paragraph 6 of Art. 5 of Federal Law No. 28.12.2010-FZ of December 395, 01.01.2011, the preferential rate could be applied subject to the conditions described above from January 01.01.2020, 210 to January 2, 01.01.2020. Federal Law No. -FZ (Article ) excluded the words “until / / ” from this rule, which means that the above-mentioned institutions have the right to apply the zero rate on income tax indefinitely (subject to the conditions set forth earlier).
